This really p!sses me off. We live next door to a church. When my husband moved into this house in 1986, the church put up a fence that is not on the property line. He was told by the church to do what he liked with that small section of the property-so he did. He has been maintaining it-i.e. mowing it. We planted on it-including a beautiful pine tree and I just planted wildflowers. Now, the church informs us that they are going to tear down the old fence and put up a new one-on the property line! Which means that we will lose our pine tree and all the wildflowers that haven't even come up yet. >:( >:(
Well, my husband is no dummy so as soon as they left, he called a lawyer friend of his. It seems like we may have a claim to the property rights of that section. We are going to file a claim under "abandon property". We were told by the lawyer that it is 15 years of maintaining the property that it is concidered abandoned. Well, since 1986-that is more than 15 years. So, hopefully, the property that we own will be expanded. Keep your fingers crossed.

The "fence is inside the property line" issue has been done to death in the courts and the property holder of record always wins in the absence of some recorded agreement.
Why not ask the attorney to waive (or reduce) his fees if you lose the case? That way you do not have to be victimized a second time.

Be sure to post the outcome of any legal action here. I'll be very interested to see how it turns out, and the basis of law that is applied. Here are some random thoughts/questions in no particular order: (I'm not looking for you to answer them. I just wrote 'em down so you can see where I'm coming from). 8)
1. Do you intend to have the plots re-surveyed so that the land is now officially yours by all public property records? If so, will your plot be reassessed and thus taxed at a higher rate? Will you then have to pay 15 years worth of back taxes on the plot?
2. What condition was the plot in before the "agreement"? Was it in disrepair? How does your locality define "abandoned"?
3. What "consideration" did the church receive in return for "giving" the land to hubby? Typically a transaction without consideration is considered invalid and generally unenforceable.
If the "15 year rule" is as you say, I am going to move to your state and start annexing abandoned rural lands like there is no tomorrow. :P

An injunction is a legal thing (at least in Britain) where a person is legally bound to stay away from another person. If s/he comes within a certain radius, penalties occur. It protects against stalkers and often comes into effect when bitter divorces occurs and one still wants to see the other despite the other persons wishes not to.
What is your equivalent in America, Howard?

You wouldn't believe the hassle I got. I admitted to him it was me that made the complaint because I believe he had suspicions it was the person sitting next to him. I reasoned with him, saying I was getting headaches and feeling nauseous because of his stale smell and that part of why he smelt so bad was because he wore the same shirt all week. He admitted that could be the cause and so I thought everything was fine . . .
He changed his ways and then, all of a sudden, my manager asked to have a word with me and now the bloke thinks I had a personal vendetta against him because I was the only person that complained (what could anyone say to him directly? 'Hey lad, you smell'?). Anyway, after my manager talked with me, I thought I would 'try to clear the air' (no pun intended) with this person. In contrast with the day before, he went absolutely mad. He said don't you realise the humiliation you have caused me? I said, that he had to be told and now that he had changed his clothes and didn't smell that bad, I had no problem with him - not good enough. He tried to reason with me that he had wore a shirt for five days, didn't wash it for a week, smelt it and still thought it didn't stink. I told him that he had no sense of smell. Now he thinks 'I'm pedantic and bloody minded'.
Needless to say, we are not talking to each other at the moment. Let's see what happens tommorrow . . . ::)

I used to work at a place that also had an employee fitness room. Anyway, we had this one foreigner and his girlfriend who used the facility. This guy never (I mean NEVER) came in with clean gym clothes and he stunk unbelieveably bad. I mean, when he walked into the room it was like taking a punch to the lungs. I wonder if you could actually die from a bad smell? ??? His girlfriend did not seem to mind it a bit, but the rest of us had a hard time breathing. :-\\
So I made up a laser-printed sign that said "I am Barely Breathing" (that song was popular at the time) and posted it on every door leading into and out of the facility, asking that the unnamed human Stink Bomb get a bath and wash his clothes. :-X
He got the message, and everybody else got a good laugh. Nobody knew it was me who posted the sign, although some had their suspicions. Heh heh... ;D

Absolutely, RockandRollFan. I go for the honest approach, maybe not the most tactful because I want this person to get the message. My view is that it will hurt for a day or two but, providing he is not a selfish imbecile, will see sense, correct his ways and job done. The bloke has been complained about twice already! You would have thought he'd evaluate his clothes-washing schedule by now.

We had this one kid when I was going to college. He always wore this nylon goose down coat. By "always" I mean ALWAYS. Like even when it was 72 degrees outside, he was wearing that friggin' jacket. I feel bad for you. I think smelly people should be told straight. I had a bad sense of hygiene growing up and I wish someone told me how bad I smelt so that I could realise this was a problem. Of course, I don't have that problem anymore. :)

That's what I like about our new cell-the caller ID which our regular phone doesn't have. But, we only gave out our cell # to those we REALLY want to talk with (except for the people who keep calling for the person who no longer has the #-Carlos said, "I wish she would stop giving out our #" lol)

That happened to me yesterday; some nearby church was having a very loud Mexican party/celebration/whatever, and it was so unbearable! >:( I'm sure we weren't the only ones calling the cops and complaining about it. That kind of thing should not have to happen. I mean, it's one thing to have a party, but to turn the volume so everyone can hear you within a ten-mile radius, that's very disturbing! >:( Fortunately, it was gone before we went to sleep.

Okay. Here's a problem. This is one of the things I'm not fond of.
Quite a few of the libraries in town have three computers. These are infrequently used, but you only pay sixty pence every hour that you want to use them. That's not a steep charge, so I'm fine with that. I might pay £1.20 if I wish to use them for two hours.
The problem being, that in one of the libraries, these are always being used by kids between the ages of 6 and 10. My beef is with the fact that while they pay for one hour's usage, they actually do nothing while on the computers, and I could, and need, to use them for other things at certain times. I'm sure others do too.
I don't know. I shouldn't complain. They're good computers, so why not..

That's illegal here. I know dogs have to be kept on leashes when they're out, and they have to be licensed. Not sure if cats have to be licensed as well, but it's the law to have them fixed.
By the way, even though some people are known to keep skunks as pets, I highly doubt the skunk in question belonged to anyone. If he did, my heart goes out to the owner.

I used to live in a town that there was this dog who would run out into the street when a car came by and tried to bite the tires. I slammed on my breaks many times to avoid hitting the dog. After driving past that house many times, I was well aware of the dog being there. I would see him standing in the yard, staring at me as I came up the street-then he would run out in the road. I said that if I did hit that dog, I wouldn't have any remorse because apparently, the owners were well aware that their dog did this-and the dog was indeed hit before. Well, I never did hit the dog but it was a really good thing that it wasn't a busy street because I'm sure I would have caused an accident by slamming on the breaks. I really wish that pet owners would be more responsible.

You know, when I was a kid, there was a dead skunk in the small slough twixt our house and our neighbors. One day we all gathered round as our neighbor got his shovel and scooped the darn thing out of the water. When he did the smell was absoutley "otherworldly." Ever since then skunk smell doesn't bother me in the least. I believe I was around 5 yrs old. Nope couldn't care less if a skunk sprayed right outside my door. BTW In my neck of the woods, the frogs are "running" to get to the lakes to hibernate. When this migration occurs, the amount of skunks laying dead on the road is staggering. The "coons are everywhere too.

YES!... that happened to me yesterday. All, I wanted to do was mow the yard and spend the rest of the day hanging with my kiddos. A friend calls and says" Hey dude, can I borrow you and your truck to help me haul some wood to the house?, It won't take long." Well, It took long... he was across Houston from his house and I was about half way between the two. :( Somethimes it sux to have a truck :P

We don't have cable by choice because we would have to have Adelpha ::). Since our local channels are on our dish, we don't need cable. Been looking into DSL but so far, it is not in our area. :(

Here's one for you, You know why Christmas time is the worst time for getting sick? Cause there are 2 to 3 times more people shopping, touching their faces and merchandise that you moments later pick up. Course you also pick up their little contribution too. X-mas shop in summer, fall, spring, don't do it in december.

A little update of the problem yesterday. It wasn't the server at all, it was the phone company. Apperantly, a cable was cut and my area was basically cut off from "the outside world". We could call to each other, but not call outside the area. And people outside the area, couldn't call in. And the number we use for internet connection is outside the area (but not long distance). Very strange.

There is a continuing problem at work where people feel the need to use huge amounts of toilet paper to wipe their backsides. There are so many toilets out of order because they are blocked full of paper.

Here it's only for the first appointment you have to hope that you're not late going in. I was slightly delayed for my first scan when I was expecting Elizabeth. The pain as the radiographer probed around trying to get the best image! Thinking about it still makes me wince.

Being the nice guy that I am, I said, hello, how are you, but then she said, "I don't wanna talk to you now, go away," and then that's when I got shoved; her left hand pushed me right in the chest above my heart. Fortunately I didn't fall down, but I was hurt (emotionally). This young lady (who may be about my age or perhaps younger than me; I'm not a very good judge of age) has a history of being nice, though. I did manage to end things on a positive note by opening the door for her as she walked out of the room.

I came very close to walking out of Pizza Hut the other week. We wait 40+ minutes for them to take our order. Another family gave up waiting and went somewhere else. I was on my own with the children (age 5 and 2) and no serving staff came near the table so I could grab them. In the end I had to leave my kids at the table and go up to the 'wait to be seated' area to get someone's attention. >:(

Having talked to a lot of people with disabilities, the one thing you can really tell with them is the fact that they have an admirable sense of life and fun, and some of these people very much inspire you to change your views on these things.
All I can really say is that since you've been with Robin, you've probably felt a lot more lifted than you have for a long time. And above all else, the sense of satisfaction you get from being with someone, whether or not they have problems, what you get back from them is worth ten times more than what couples usually get from each other.

That was very nice what you said, Bobo. :) Although, I can't really say whether being with me is a life-altering experience, since my outlook on life is not always wonderful sweet smelling roses at best! I would like to hope that I've changed some people's minds about people with disabilities in that we're human beings too. Not charity cases. Not people to take pity on. (Please don't, I hate that.) I do wonder what goes through people's minds when they see me and Rush together though. We do get stared at a lot. Like, haven't they seen a crippled girl with a guy before? Do they not think able bodied dudes like chicks in chairs? Well, I think I found a special one in Rush, and I'm quite lucky and happy to have him. ;D

That was very nice what you said, Bobo. :) Although, I can't really say whether being with me is a life-altering experience, since my outlook on life is not always wonderful sweet smelling roses at best! I would like to hope that I've changed some people's minds about people with disabilities in that we're human beings too. Not charity cases. Not people to take pity on. (Please don't, I hate that.) I do wonder what goes through people's minds when they see me and Rush together though. We do get stared at a lot. Like, haven't they seen a crippled girl with a guy before? Do they not think able bodied dudes like chicks in chairs? Well, I think I found a special one in Rush, and I'm quite lucky and happy to have him. ;D
A cynical outlook on life happens to everyone to some degree, Vile (I used to withdraw away from people because of it) but you come across as mentally and emotionally strong and therefore people who might have thought about taking pity on you realise that the notion is wasted.
I have mentioned previously in another post on the boards that I used to go to a handicap playgroup and that knocked out any kind of bigotry I would have had for disabled people (in any form). I think it was one of the best things my mum ever taught me. :)
As for Rush, he seems to be a very special person . . . You both are.

Well, I'm just one big cynic. :) Most people would call me a pessimist! No, I'm a realist! And me? Emotionally and mentally strong? Me? Well, I suppose I can be. I have been lately, I think. (Rush may or may not agree with me.) I certainly haven't sunk into any deep depressions lately.

My parents saw to it that I was, regardless of what the "powers that be" said (i.e. the school district). Didn't always get the kids to be more "conscious" of people who are different. I made a lot of enemies as I grew up into a teenager. When I was a youngster, I was more of a "curiosity" more than anything, so of course I had loads of friends.
As for Rush, he seems to be a very special person . . . You both are.

I have read somewhere that cynical people are more idealistic than idealistic people. It's just that cynicism is a way of protecting themselves against the harsh realities of disillusionment - a defence mechanism. Being cynical/realistic is only negative when it becomes chronic.

Kids don't usually understand what disability is about and can often spell trouble for the disabled person.

I agree. I know that my parents wanted me to be in a "normal environment" (there's that word again!) and they wanted me to be with...er...not just handicapped people. Yes indeed, it can spell trouble because some kids can't, don't and sometimes refuse to understand that just because someone looks different, it doesn't mean that he or she is different. And it did for me as I got older! Popularity became more of an issue, and of course you had to look good to be popular! Some kids thought I looked like a freak for whatever reason, so I got teased. And unfortunately, it still stands today that some people, when they think of handicapped people, the image of a non-communicative deaf-mute in an electric wheelchair hooked up to a respriator or God knows what with a colostomy bag hanging off it comes to mind. It's sad.
My education, dear Bobby, comes from life! Oh yes, I went to school, but I wasn't very good at it, especially later on. I was good with some things, especially French, but I hated to study...and especially hated to dissect books and poems in English class! (I also didn't like science, speaking of dissecting things.) :P

That's a real bummer, Howard. And, as unhelpful as it is for me to say this, your situation sounds like one I can really relate to, as when I was younger I was good friends with a chick with spina bifida cystica, and for a while we were very much with each other in the same sense.
Having talked to a lot of people with disabilities, the one thing you can really tell with them is the fact that they have an admirable sense of life and fun, and some of these people very much inspire you to change your views on these things.
All I can really say is that since you've been with Robin, you've probably felt a lot more lifted than you have for a long time. And above all else, the sense of satisfaction you get from being with someone, whether or not they have problems, what you get back from them is worth ten times more than what couples usually get from each other.
Hang on in there, Howard. You know how rewarding this is going to be for you.

Thanks Vile.I know I can count on you for good advice.See,after Randy's Mother died in 1996 he became more of a huge loafer,lazy and lives off government money.He also has to put up with his mentally retarded brother and sister who are both Down Syndrome.He doesn't have a job,has girls come over to his house and has sex with them.He's a bad influence but I've know him for almost 10 years and I just don't take his advice cause he hasn't been in my shoes before. >:(

Everone has defects, Howard. Some just have outward ones other are inward. There is no such thing as the "perfect" person. I think you need to lose the friend...obviously his idea of how things work didn't help him any. You are doing the right thing in dating a girl you like. Just treat her right and things should go ok.

I came very close to walking out of Pizza Hut the other week. We wait 40+ minutes for them to take our order. Another family gave up waiting and went somewhere else. I was on my own with the children (age 5 and 2) and no serving staff came near the table so I could grab them. In the end I had to leave my kids at the table and go up to the 'wait to be seated' area to get someone's attention. >:(
While we're on the subject...I HIW the servers/waiters/etc. just flat out ignore you in the restaurant. One time a few years back, we went to a Marie Callenders where we got seated, but never got served. I'm serious; the waiter walked right past our table, acting as if we weren't even there. We couldn't even place our order. So we complained to the management: "This is the first time we've been here, and it's going to be the last." And we stormed out. >:(

I mean,I've known Randy for about 10-11 years here and there.After his Mother passed away in May of 1996,He couldn't find a way of taking care of his 2 Down Syndromed Brother & Sister which is now taking it's toll on him.He feels worthless of himself,lives off government money(SSI)I've seen him.He's a big loafer,very lazy,has girls come to his house and has sex with them ::), a bad influence & all he does is talk to his"b-i-t-c-h-e-s"on Yahoo Instant Messenger.Now,is that a good life to live? >:(
