Subject: Songs with uncredited samples

Written By: XYkid on 03/28/14 at 5:32 pm

What I mean by this is songs that sound very similar to other songs but yet there is no credit given to the original artist.

Here's an example, these two songs both use the title Upside Down, and use the lines "Upside Down...Inside Out" in the chorus. How did they not realise this?

I always thought these two sound similar.  They are both 70s songs. The 2nd one is probably unknown to most here (except Whistledog)

Didn't Vanilla Ice get sued for taking the base line from someone for Ice Ice Baby?

I'm glad I'm not the only one who thought these sounded familiar.  To be fair, the Wednesday version was a cover of a 60s song, but as I still have no idea what that version sounded like, Vanity Fare would be the samplers lol

Under Pressure by Queen and David Bowie.  He thought that by adding an extra bass line in the sample, he wouldn't need permission to use it.

There was a Europop duo from Germany called Modern Talking.  In 2000, they released their 9th album and contained within was an album track that has a very familiar saxophone intro, but the linear notes did not include any information if it was a sample ...

I was not fooled though.  Speed ahead in this next song to 2:17 and you will see.  Of course, if you know your 80s music, then you should recognize it already ...

Emerson Lake & Palmer based Knife Edge from Leoš Janáček Sinfonietta. It wasn't until the family sued for
copy write infringement that ELP gave credit for the song.

I remember when Tommy Page got sued by Percy Sledge because he said that he wrote the same song.  But Percy lost the lawsuit because he couldn't prove that Tommy and the New Kids took his song.

Percy's song doesn't sound a thing like Tommy's song.

"Ready for Not" by The Fugees

7eqINPjEDM4

"Ready or Not" is a song by the American hip hop group The Fugees, from their second studio album The Score (1996). The song contains a sample of "Boadicea" by Enya, and its chorus is based on "Ready or Not Here I Come (Can't Hide from Love)" by The Delfonics. While "Ready or Not" was a minor hit in the United States, the song was most successful in Europe, particularly in the United Kingdom, where it peaked at number one on the UK Singles Chart. It remained at that position for two weeks, becoming their second chart-topping single of 1996 there, following Killing Me Softly. Singer Enya was prepared to sue the group for copyright infringement, because she had not permitted the group to sample the song "Boadicea", from her 1987 album Enya. She eventually settled out of court.

The Turtles on the right and De La Soul's You Showed Me on the left.  De La Soul got sued by The Turtles because they sampled 12 seconds of the song So Happy Together and they didn't credit them for the song.  The lawsuit was settled out of court for 1.7 million and future royalties from the sample.

I think you meant the Turtles song "You showed me" , not Happy Together?

That's why when I hear it I never know if I'm going to hear Queen & David Bowie or Vanilla Ice.

Yes that's what I mean.  I didn't know which song they had claimed was hijacked.

It has been suggested that the chords and melodic structure of "Happy Xmas (War Is Over)" bear more than a passing resemblance to the traditional English ballad "Skewball", specifically the 1963 rendition (titled "Stewball") by Peter, Paul and Mary, itself based on the classical version recorded during the early 1940s by folk singer Woody Guthrie.

Listen to the backing vocals of the Yes song; at about the 3:00-3:18 mark you will hear the lyric
"All we are saying is give peace chance."

M.C. Hammer got hammered over this one.  ;D

The songs sound exactly the same.  Rick James successfully sued Hammer for copyright infringement.  The suit was settled out of court and Hammer agreed to give Rick and his writting partner a songwritting credit.  :)

LL Cool J took the chorus sample from The Mary Jane Girls song All Night Long in 1983.

^ That one wasn't uncredited though.  LL Cool J got permission from Rick James to use that song and his name appears in the song writing credit.

How do you go about asking permission when using a sample in a song?

Well,  I would think that you offer the original songwritter a lump sum of money for their song and run it by a lawyer to make sure that the offer is fair and acceptable.

so they don't wind up suing you for copyright infringement.

Along with Felton Pilate and other Rick James group members, Rick James sued Hammer for infringement of copyright, but the suit was settled out of court when Hammer agreed to credit James as co-composer, effectively cutting James in on the millions of dollars the record was earning.

Here's another more recent example. Both of these have a very similar opening in their chorus (and the latter sounds obviously 80s-inspired).
