It doesn't look like a smile to me. It looks like a look of annoyance or anger like somebody who is still feeling violent. Perhaps he was under the influence? But then, people are seldom in a good mood when a mug shot is being taken.

Well now that he might be perceived as a “bad boy”, his film career could see a resurgence. ;)
